At LATAM Rides LLC (“LATAM Rides” or “We”), we take your privacy very seriously. This Privacy Policy applies to information gathered in your use of the LATAM Rides website and related apps, as well as any information gathered from third-party sources, or information as may be required in the fulfillment of LATAM Rides services.

Information You Provide to Us

• User Account Data: In order to register an account with LATAM Rides, we may collect certain personal information including your name, email address, postal address, phone number, and any other information you choose to provide. In addition, you may be asked to provide certain sensitive personal information including your driver’s license, or certain biographical information to confirm your identity.
• Vehicle Information: When renting a vehicle through these services you shall be required to provide listing details, vehicle identification number (VIN), pictures of the vehicle, insurance and availability dates.
• Payment Data: You may be asked to provide payment information in connection with your use of our Service. Any financial information you provide, such as your payment method (valid credit card number, type, expiration date or other financial information) is collected and stored by Stripe, our third-party payment processing company, and use and storage of that information is governed by Stripe’s applicable terms of service and privacy policy.  
• Communications: We shall collect information provided when you contact us for customer support, or to report an accident or issue with this service, or when you contact another user, or enter into an agreement with them through this platform.

Information Automatically Collected

• Device and Usage Information: We collect information about how you access our Service, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, and browser type. We also collect information about your activity on our Service, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Service.
• Location Information: In accordance with your device permissions, we may also collect information about the precise location of your device. You may stop the collection of precise location information at any time.
• Transaction Data: When you make a reservation or book a rental through our Service, we collect information about the transaction, such as rental price, and date and location of the transaction.
• Information Collected by Cookies or Similar Tracking Technologies: We use tracking technologies, such as cookies and web beacons, to collect information about you. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that may be used in our Service or emails and help deliver cookies, count visits, and understand usage and campaign effectiveness.

Information Gathered from Third Party Sources

• Background Check Services: To the extent permitted by applicable laws, we may obtain additional information about you from public records, background check providers, or other screening services and information about criminal convictions. We may use the information you provide to us to obtain such reports.
• Third-Party Services: Additionally, we may collect data from credit reporting services, fraud detection information, mailing list providers, and other demographic information from publicly available sources. We may combine the information about you that we receive from third-party sources with other information we have about you.
• Other Sources: if you create or log into your LATAM Rides account through a third-party platform, we will have access to certain information from that site, such as your registration and profile, which we shall use in accordance with the practices outlined in this Privacy Policy.

How and Why We Use Your Personal Information 

Under applicable data protection laws, we can only use your personal information if we have a proper reason for doing so, for example:

• To comply with our legal and regulatory obligations
• For the performance of our contract with you or to take steps at your request before entering into a contract

• Other LATAM Rides users, for the purposes of sharing vehicle information, or facilitating a transaction. We provide your information to other users as necessary to facilitate transactions between users. 
• Our affiliates, and the service providers who assist us in providing our services to you, such as payment service providers
• Third parties approved by you, including social media sites you choose to link your account to 
• To credit reporting agencies or identity verification services
• To our professional advisors, which may include lawyers, bankers, auditors, and insurers
• With law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations

We only allow our service providers to handle your personal information if we are satisfied, that they take appropriate measures to protect your personal information. 

Personal Information We Sell or Share 

We do not sell or share your personal information and will not do so in the future without providing you with notice and an opportunity to opt out of such sale or sharing. Information is only shared with trusted service providers such as payment processors.

Cross-Border Transfer

LATAM Rides is headquartered in the United States, although we work with service providers in other jurisdictions. Accordingly, your personal information may be used, stored, and processed in any country where we have facilities or in which we engage service providers. These locations may be outside of your state, province, or country of residence, may have different and/or less protective data protection rules than those of your home jurisdiction, and may be subject to regulations and laws in that jurisdiction. We will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it. 

We ask that you not send us, and you do not disclose, any sensitive information (e.g., Social Security numbers, social insurance numbers, passports, information related to racial or ethnic origin, or health) on or through the Services or otherwise to us unless specifically requested.

Security

We employ technical, physical, and organizational safeguards designed to protect information against unauthorized access while it is under our control. However, no method of transmitting or storing information can be 100% secure and we cannot guarantee the security of your personal information. 

Communication preferences 

Through your LATAM Rides account you may manage settings whereby we may contact you regarding your bookings, listings, as well as promotions, and announcements.

Opting out of marketing communications

Marketing-related emails to which you have expressed an interest shall contain unsubscribe instructions at the bottom of the email. You will still receive service-related emails.

Correct and Update

You may review, correct, or update any information that you have provided by accessing the corresponding account or profile settings. 

Account Closure 

You may close your LATAM Rides account and request deletion of your information by contacting us at latamrides@gmail.com.

Please be aware that we will not be able to delete data to the extent it is still required to fulfill a legitimate interest such as concluding a transaction through these services, for fraud prevention purposes, or to enforce our Terms of Service. 

Information Sharing Choices

Please be aware that privacy or security settings choices you may make may limit our ability to provide you with certain features and functionalities of these services. In some cases, we may not be able to comply with your Privacy requests where a legitimate interest, such as compliance with applicable law may prevent us from doing so. 

Third-party Platforms and Social Media

If you choose to access or use LATAM Rides through a third-party platform or social media network, by using that third party’s authentication service to log into your account on the Services, you may be able to control your settings through the third-party platform or social media network.

Data Retention

We will keep your personal information while you have an account with us or while we are providing services to you. Thereafter, we will keep your personal information for as long as is necessary:

• To respond to any questions, complaints, or claims made by you or on your behalf
• To show that we treated you fairly –or–
• To keep records required by law

We will not retain your personal information for longer than necessary for the purposes set out in this policy to fulfill any legitimate interest for which it is provided.

It is our policy to post any changes we make to our Privacy Policy on this page. The date the Privacy Policy was last updated or revised is identified at the top of the page.
